What does Regulation 44A mean?
Regulation 44A allows services to take spare capacity in the under 2 age group into account in determining the staff required for children aged 2 and over.
The intention of this regulation is to allow flexibility for services in managing children during their transition into over two-year-old licensed spaces.
Regulation 44A affects centres with mixed age groups where the number of children aged two and over is such that the attendance of an additional child (or children) aged two or over would mean an additional teacher would be required to meet minimum ratio staffing levels.
How does it get applied within your Roster/ Contact Hours pages in Juniorlogs?
• If there is a spare capacity in the under 2 age group, the additional child (or children) can be counted in the under 2 ratio.
• If there is no spare capacity in the under 2 age group an additional teacher would be required.
For eg: for the below time slot, the number of Under 2 children is 1 and Over 2 is 9. When regulation 44A is not applied, the staff numbers required are as below:
When regulation 44 A is applied, 4 Over child will be moved to Under 2 capacity to reach the max Under2 capacity (it is 5 here) for the staff who takes care of Under2 children. As a result, the Minimum Staff Required will be calculated as 1 + 1 = 2 and the Qualified Staff Required for max funding will also be calculated accordingly.
